Terms of service
Last updated: October 2026
1. Who we are
OpenSoon is a trading name of Ruslan Balzhyk, a sole trader based in Bulgaria. OpenSoon is not a company. In these terms "we" and "us" mean that person, and "you" means the business that subscribes or requests a sample. Contact: hello@getopensoon.com.
OpenSoon is a business-to-business service and is not offered to consumers. By requesting a sample or subscribing you confirm that you are acting for a business.
2. The service
Every week we deliver a file (CSV and Excel) of newly registered, newly opened and closed food and drink venues in the region you subscribe to, or the whole UK, with a short summary email and a private web page where you can see the latest and previous weeks. The fields and sources are described on our website. We may improve or change the fields over time, and we'll tell you before removing a field you rely on.
Your private page link is personal to your business. Keep it confidential, and tell us if it may have been shared so we can replace it. We may replace the link at any time, and it stops working while your subscription is paused and when it ends.
3. Free samples
One free sample per company, for evaluation only. There is no free trial of the subscription.
4. Fees and payment
- One region: £99 per month. Whole UK: £249 per month.
- We are not registered for VAT in the UK and don't add VAT to our prices. If you are a VAT-registered UK business, you may need to account for VAT on our services yourself under the reverse charge.
- Your first month is a paid founders' pilot at a discounted rate. After that the standard price applies.
- We invoice monthly in advance, in pounds sterling. Invoices are payable within 14 days by bank transfer, or online where we offer it.
- If an invoice is unpaid 14 days after its due date, we may pause deliveries until it is paid.
- We'll give you at least 30 days' notice by email of any price change.
5. Renewal and cancellation
Your subscription renews every month until you cancel. You can cancel at any time by emailing hello@getopensoon.com. Cancellation takes effect at the end of the month you have paid for, and we don't refund part months. We may end the service by giving you 30 days' notice, in which case we refund any month paid for and not yet delivered.
6. Licence and use of data
- We grant you a non-exclusive, non-transferable licence to use the data for your own internal sales and marketing while you subscribe.
- You may not resell, publish or redistribute the data, or supply it to third parties, except to service providers acting for you.
- You must keep the attribution notices that come with the files (Open Government Licence sources).
- When your subscription ends you may keep records you have already acted on, such as leads in your CRM, but you may not keep using the files to market to new prospects.
7. Your compliance responsibilities
You decide how you use the data, so you are a separate controller of any personal data in it. You are responsible for using it lawfully, including under the UK GDPR and the Privacy and Electronic Communications Regulations (PECR). In particular:
- Send unsolicited marketing emails only where the file marks email as allowed (incorporated bodies), and always include an opt-out.
- Don't email sole traders or partnerships without their prior consent.
- Screen phone numbers against the TPS and CTPS before making marketing calls.
- Respect any objection or opt-out a business gives you, and pass on to us any request to remove a business from our data.
We may suspend or end your subscription without refund if you seriously or repeatedly break this section or section 6.
8. Accuracy
The data comes from public registers and websites and is supplied "as is". We work to keep it accurate, for example by confirming closures over two register publications, but we don't guarantee that every record is complete or current, or that the service will be uninterrupted. If a weekly file is late or faulty, tell us and we'll resend or correct it.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that can't be limited by law. Otherwise, our total liability to you in any 12-month period is limited to the fees you paid us in that period, and we aren't liable for loss of profit, revenue or goodwill, or for indirect or consequential loss.
10. Payment providers
If we offer online payment, it may be handled by a merchant of record (for example Creem), which sells the subscription to you on our behalf. Its terms then also apply to the payment, and its invoice replaces ours.
11. General
- We may update these terms. We'll email subscribers at least 30 days before a change that affects them takes effect.
- We may send notices to the email address you gave us. You can send notices to hello@getopensoon.com.
- These terms are the whole agreement between us about the service.
- If we incorporate a company to run OpenSoon, we may transfer your subscription to it. We'll tell you first, and your rights won't be reduced.
- These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction.
